Terms and Conditions

Quotations

Pricing includes site measure, manufacture, supply, delivery and installation of benchtops and/or splashbacks only, based on one (1) site
measure and one (1) installation visit unless otherwise stated. Unless specified, pricing does not include undermount sinks, waterfall ends
or splashbacks or installation above ground floor. Glass splashbacks colour ranges are from our specified supplier. Samples available to view
in our showroom and /or with our templater. Additional charges for any colour selection outside of these ranges. All prices are based upon
the present cost of labour and materials and firm for 30 days from the date of quoting. All prices are subject to a 10% Goods and Services
Tax. Quotations are based upon the information supplied by the Client and/or on site measure, and thus the price may change if variations
are identified. Prices do not include fixing of sinks, hotplates, basins or taps. The Seller Simple Benchtops recommends the use of a licensed
tradesman. The Seller Simple Benchtops reserves the right to refuse any works should it deem necessary. All benchtops and/or splashbacks
will remain the property of the Seller Simple Benchtops until the Client has paid all the amounts owing for the scope of works described.
Should the Client fail to settle the account (s) as per conditions of trade stated within, the matter will be forwarded to a solicitor and / or
debt recovery agency for which all legal costs will be the Clients liability. The Seller Simple Benchtops reserves the right to enter upon and
into land and premises owned, occupied or used by the Client as the invitee where the benchtops / splashbacks are situated and take
possession of the benchtops / splashbacks.

Templates / Site Measure

Please ensure your cabinets are in position, fixed and level with all appliances such as sinks , hotplates and substrates with appliance cut
outs done (screwed down from underneath where applicable for all benchtops over 20mm) ON SITE to avoid a call out fee to return to site.
If glass splashbacks are being measured, please ensure overhead cabinets are fixed and in position with rangehoods removed for accurate
measurement of hole locations if glass is to be installed behind rangehood. Where existing tops are remaining and stone is being measured
for an overlay over existing benchtops, please ensure that all tops are clear of all items and all appliances ONSITE and disconnected and
removed. On occasion existing tops become out of level over time and an accurate measure cannot be completed. On occasion existing
tiles / splashbacks will need to be removed prior to measure. Cabinetry levels must be checked prior to our visit or we may have to return
when cabinets are adjusted and a call out fee of $165 inc gst will apply. We will physically need the appliances on site and disconnected to
ensure an accurate measure of your cut out locations and sizes. Templates from the manufacturer will not be suitable as details provided in
specs may not always be accurate. Where drawings require an adjustment or alteration after final site measure has been completed, an
administrative fee of $55 inc gst will be applicable. Note that maximum unsupported overhang is 300mm and MDF substrates are not load-
bearing and overhangs over 300mm must be reinforced with steel bracing, brackets or legs by the Client. Locations of joins is at the
discretion of the stonemason unless otherwise agreed.

Payment Terms

A 60% deposit is payable upon confirmation to proceed with the order, 30% payable to confirm installation booking and 10% on the day of
completion. Any return to site outside of the initial site measure and installation will incur a call out fee of $165 inc gst (which includes the
first hour of works). Additional time on site will be charged at $121 inc gst per hour. If we attend site measure and/or collect templates and
the templates and / or the cabinets are not ready for collection, a $165 inc gst service fee will apply. If the Client is not present to sign off
the installation and we are then required to return to the job to obtain sign-off and collect payment, a $165 inc gst service fee will apply.
Where an order is cancelled after a deposit is paid and / or there is a change of material and/or colour , a $220 inc gst charge is applicable
for handling of materials and administration fees in addition to the restocking costs incurred by the supplier. Deposits will be refunded less
above mentioned charges. A one – time Late Fee charge of 2.5% of the invoiced amount will be charged if an account payment is not
received by the due date once the project is completed. We prefer payment by bank transfer, however, cheque or cash are accepted.
Credit card facility is available, however please note this will incur a fee of 2.5% of the transaction total. Where the Seller Simple Benchtops
is required to engage in debt collection, the Client will be liable for all costs associated in the process of debt recovery.

Lead time / Timeframe

The Seller Simple Benchtops will process orders after receipt of 60% deposit and a signed copy of this agreement. Any deposit received will
be granted as approval to proceed with manufacturing order and acceptance of Terms and Conditions. We aim to have all orders
manufactured and installed within 10-12 business days. Due to unforeseen issues, these lead times may be subject to change and The
Seller Benchtops has the right to change expected install dates. The Client acknowledges that the Seller will not be liable for any delay in or
supply or availability of material, or costs associated with delays. The Client will be notified immediately of any delay in production. The
expected installation date will be confirmed upon completion of manufacturing. In peak periods, this may extend to and up to 15 business
days or more. Where stone and glass are measured at the same time, installation of stone and glass will be scheduled together except in
cases where other arrangements have been made.

Preparation of Site

The site for which works will be undertaken shall be prepared with cabinets installed, level and straight. This may include, but is not limited
to, the removal of existing benchtops and splashbacks, preparation work and substrates fitted where required. If the templater/installer is
not able to measure/install to 100% of the scope of works due to out of level cabinets, uninstalled cabinetry or no clear access to property
from driveway, including, but not limited to; muddy ground, unsafe ground or hazardous walkway, a call out fee of $165 inc gst in addition
to $121 inc gst per hour will be charged and the install rescheduled at a time when site is ready and call out fee is paid.

Installation

The Client shall be available to allow the Seller Simple Benchtops to gain access to the site for installation of the benchtops. Should the
Client not be available, the installation will not take place. The Client must assess the completed scope of works and sign the Installation
sheet as provided by the installer on site. Once installation has been completed The Seller Simple Benchtops will do a general trade clean
only. Detailed cleaning is not our responsibility. Be aware that all granite, marble and quartz are natural materials which do have colour &
texture variations. The Seller Simple Benchtops supplies white, off-white or clear silicon only. If any other colour is required this shall be
supplied by the client. Caulking is not the responsibility of the Seller Simple Benchtops. The Seller recommends a professional caulking
service. The Seller Simple Benchtops recommends that material is viewed at the relevant supplier’s warehouse prior to confirming colour
selection. Installations outside of 50km from Dandenong South will be charged at $4.40 inc gst per kilometre. Due to Occupational Health
and Safety regulations, all employees of the Seller Simple Benchtops are required to wear protective footwear at all times whilst on site. All
care will be taken whilst installing however, it is the responsibility of the Client to insure their floors from the risk of damage by having
sufficient floor covering.

Warranty of Workmanship

All scope of works relating to the installation of the benchtops is covered by a 12 month workmanship warranty. Any damage to benchtops
and/or glass splashbacks post installation will not be covered by The Seller Simple Benchtops warranty of workmanship and all costs
associated with repairs or replacement will be at the responsibility of the Client. Where a reconstituted (engineered) stone is supplied the
relevant manufacturer’s warranty will apply. It is the Client’s responsibility to register their warranty directly with the supplier. Please refer
to the manufacturer’s website and/or Care and Maintenance publications for reconstituted (engineered) stone. All faults related to the
stone are related to the manufacturer of the materials and will need to be registered directly with the manufacturer. There are no
warranty’s applicable for natural stone.

Care and Maintenance

The Seller Simple Benchtops does not recommend marble to be used on kitchen surfaces as marble in comparison to granite and
reconstituted stone is more porous and softer. Please refer to the manufacturer’s Care and Maintenance publications for reconstituted
(engineered) stone. Do not place hot items directly from the oven and cooktop directly onto the benchtops.

Safety

All care is taken when installing the product and the Seller will take all reasonable precautions to minimise the creation of dust. The Seller
Simple Benchtops does not accept any responsibility to goods and/or chattels on the premises which are damaged as a result of dust which
is created when the cutting of marble, granite or reconstituted stone is done. The owner acknowledges that it is their responsibility to cover
all floors, appliances and equipment which may be affected by the dust and to remove items which may be damaged by dust.

Agreement

I have read and understood the TERMS AND CONDITIONS OF TRADE of Simple Nominees Pty Ltd trading as Simple Benchtops and I agree to
be bound by these conditions. Any deposits paid or correspondence stating approval to proceed are deemed as acceptance of the quote
and Terms and Conditions of trade.
